Terms of Service
Updated September 29, 2026
These terms are the agreement between you and Fonderful (operated by Adam Lorber) for using the app and the send service. If you do not agree, do not use Fonderful. Privacy is part of this agreement. Read it with these terms.
Who this is for
You must be 18 or older to use Fonderful as the sender. This is a tool for writing and emailing notes. It is not a mailbox we host, not storage for the words you send, and not medical, legal, or emergency advice.
What Fonderful does
You add people you already know, write a note, and send it as email. The first time you send to someone new, we email a confirmation link to that inbox; until then the note can wait on your device and deliver after someone with access to the inbox taps the link. You can send to someone who checks mail today, or to an address you are holding for later, often for a child. Confirmation still requires access to the inbox. After a send succeeds, Fonderful does not keep the note in our own database.
Your responsibilities
You are responsible for who you add and what you send. Use an address you are allowed to contact. Do not add a stranger, scrape addresses, or use Fonderful to harass, defraud, spam, or send anything illegal. The people you add did not create a Fonderful account. Confirmation only proves that someone with that inbox tapped a link; it does not transfer your duty to use the address lawfully.
If you hold an address for a child, you are the sender. You decide which address to hold. Do not create a Fonderful account in a child's name or invite a child to use the app as the sender.
You are responsible for the content of every note, photo, video, voice memo, and file you attach. Do not send anything you do not have the right to send.
Email is not a guarantee
Mail goes out through Resend, a third party mail service. Delivery can fail, delay, or land in spam. The recipient's provider, filters, and a full or closed inbox are outside Fonderful's control. We do not promise a note will arrive, arrive on time, or be read only by the person you named.
Resend may keep a copy of a sent email, including its content, in their logs for about 30 days. That is their copy for delivery and debugging, not a Fonderful archive. Replies go from their inbox to yours. Fonderful never sees the reply.
Accounts and this device
Signing in with Google or Apple is optional. Without it, people, drafts, and settings stay on this device. With it, that list can restore after a reinstall. You are responsible for who can unlock this phone and this account.
Limitation of liability
Fonderful is provided as is. To the fullest extent the law allows, we make no warranty that the app or mail sending will be uninterrupted, free of errors, or fit for a particular purpose, including that a memory will reach someone on a given day.
To the fullest extent the law allows, Adam Lorber and Fonderful are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost notes, failed or delayed delivery, a message in spam, a note read by someone you did not intend, Resend or other third party outages, or what a recipient does with a message you sent.
If a court still finds us liable, our total liability for any claim is limited to the amount you paid us for Fonderful in the twelve months before the claim, or ten US dollars if you paid nothing. Some places do not allow certain limits. In those places, the limit applies only as far as the law allows. Nothing here limits liability that the law says cannot be limited, including for fraud or for death or personal injury caused by negligence where that bar is not permitted.
If you cause harm
If someone makes a claim because of notes you sent, people you added, or how you used Fonderful, you will cover the costs we reasonably incur as a result, including legal fees, to the extent the law allows.
App stores
If you download Fonderful from the Apple App Store or Google Play, Apple and Google are not parties to this agreement and are not responsible for the app or these terms. Your use of their stores is also under their rules.
Changes and contact
We may update these terms. If the change is material, the app will ask you to read and accept the new version before you keep using Fonderful. Continuing after you accept means you agree to the update.
Questions: hello@fonderful.app. These terms are governed by the laws of the United States, without regard to conflict of law rules. If a part of this agreement cannot be enforced, the rest still applies.
